Dressed to the nines, Uranus and her lawyer appeared in court for the criminal proceedings, the first of two child neglect hearings to be held resulting from her prior arrest. The hearing, however, turned out to be a joke. Child Protective Services was totally unprepared and the contract lawyer that represented them, having been assigned the case the day before, was literally eaten alive by Uranus’s lawyer, Guido. The Judge listened to all that was said, reprimanded the police and CPS, pounded his gavel and formally dismissed the criminal hearing. He said “I will review the case, and report back to everyone in a week or so.” A few weeks later, the Judge released his findings. There was no surprise. The police and Social Workers had entered the apartment without a warrant. All were reprimanded in writing by the Judge. Entry and seizure of the children by Social Services was deemed to be totally illegal by the Judge. The Judge dismissed the case, and returned full custody of the children to the mom. In a later appeals hearing, one that Uranus did not attend, the Judge also expunged the entire criminal case from Uranus’ record. However, the neglect hearing was still an open issue and yet to be held. Guido was beside himself, polishing his own apple, stating what a clever job he had done. He actually dropped by my apartment to show me how much testimony he had expunged from the hearing record. The dropped material would not be allowed in the follow-up Social Services neglect hearing. He showed me a fist full of paper with blacked out lines throughout. He had removed most of the testimony, and all of the evidentiary proof. Guido said, “The CPS neglect hearing will be a breeze.” It was at this meeting in my apartment when Guido admitted to me that he knew Uranus was mentally ill and seriously in need of psychiatric help. I asked him why he was representing her, and he replied, “I signed up for the criminal case, and now I must to follow through, even though this type of case is out of my element. After all, I am a criminal lawyer and that is why I took on the case in the first place. I won that side of the case. I need to hang in there with her. We’ll win the next one too” I wondered why he was sticking with her. Was he that hard up for money? Was it something else? It must be all the free Five Guys Burgers she was buying him. So much for the kids, the criminal hearing was over. STRIKE ONE for the good guys! Back to normal for now, or I should say back to abnormal. What would be the outcome of the neglect hearing? We would need to wait and see.
